This document outlines our terms for doing business. We have made it as straightforward as possible and are intended to protect both parties.
THE CONTRACT.
You agree to abide by these terms and conditions when you book and pay a deposit or the full tour or workshop fee.
We agree to these terms and conditions when we confirm your booking in writing.
DEPOSITS AND PAYMENTS.
The workshop and tour deposits are required to secure the booking for the specific date of the workshop.
Please note that deposits are non-refundable however can be transferred to any other workshop.
The remaining balance of the workshop or tour fee is to be paid 30 days prior to the scheduled workshop date.
For bookings made less than 30 days prior to the workshop date, full payment will be required at the time of booking.
CANCELLATIONS.
If the guest cancels the workshop less than 30 days before the workshop date, the guest will be responsible for the full cost of the workshop. However, every attempt will be made to fill the cancelled spot, and if successful, the booking may be transferred to another workshop.
If the guest cancels the workshop more than 30 days prior to the workshop, the deposit will be retained.
Phuket Photography Tours retains the right to cancel the workshop up to 30 days before the scheduled date. In such cases, we will make every effort to arrange an alternative workshop for the guest. If transferring the booking is not feasible, a full refund will be provided.
In the event of a cancellation that is beyond the control of Phuket Photography Tours, such as natural disasters or illness of the instructor or guide, we may provide the guest with less than 28 days' notice. In such cases, the funds paid will be transferable to another workshop.
ALTERATIONS TO THE TOUR.
As we conduct workshops in Thailand's tropical climate, we are subject to the unpredictability of weather conditions. In the event of poor or inclement weather during a workshop, it may be necessary to conclude the session early. Please note that this is beyond the control of both participants and Phuket Photography Tours. However, we will make every effort to offer alternative indoor instruction as a substitute in such situations.
DIETARY REQUIREMENTS.
Kindly provide us with any dietary requirements at the time of booking. While we will make every effort to accommodate such requests, we cannot guarantee that all dietary needs will be met. We assume no liability if we are unable to fulfil specific dietary requirements.
BEHAVIOUR.
It is important that you behave in a manner that is not disruptive, upsetting, or dangerous to yourself or others during the tour or workshop, and to follow any reasonable instructions given by the tour or workshop leader. You may be terminated from the tour or workshop by Phuket Photography Tours if your behaviour is, in the tour leader's opinion, in breach of this obligation, and Phuket Photography Tours will not be responsible for any further claims.
INSURANCE.
The contract between us requires you to obtain appropriate travel insurance before embarking on the tour in Thailand. It is recommended that this is done at the time of booking. There must be coverage for losses, expenses, and damages arising from, among other things, the cancellation of the tour or workshop (whether in whole or in part), personal injury and accident, medical and repatriation costs, loss of baggage, money, and belongings, as well as cancellation and delay of transportation. Phuket Photography Torus cannot be held responsible for the costs incurred as a result of your failure to comply. We strongly recommend that you purchase an insurance policy that covers loss, theft, or damage to your photographic equipment.
PASSPORTS/VISAS & MEDICAL.
Clients are responsible for obtaining a valid passport, all required visas, permits, and certificates, including medical certificates, during their entire journey. Unless otherwise stated, all information and advice provided by others regarding visas, vaccinations, climate, clothing, luggage, special equipment, etc., is provided in good faith. When booking, please let us know if you have medical or mobility problems, need a wheelchair or use walking aids. Covid-19-related certification or evidence may be required, where applicable.
MEDICAL EMERGENCY.
There is not a medical team accompanying Phuket Photography Tours. Neither Phuket Photography Tours nor any of their employees are equipped or trained to deal with a medical emergency. It is important that you disclose any medical condition that could require emergency treatment at the time of booking so that Phuket Photography Tours can determine if the tour is safe for you.
RISK.
You, the client, understand that during the course of a tour or workshop with Phuket Photography Tours you will visit a variety of outdoor locations. You understand that during the full duration of the tour and when travelling to and from the locations, you do so at your own risk and you take full responsibility for your actions.
FACEBOOK COMMUNITY MEMBERSHIP.
This service entirely at the discretion of Phuket Photography Tours and membership may be declined in exceptional circumstances for example where the member does not follow the community rules and regulations.
PHOTOGRAPHS & EMAIL.
We may wish to take photographs and video during the running of your tour experience and use the resulting image/s and footage for promotional purposes. You should inform us before the workshop if you do not consent to such use of image/s or video.
INTELLECTUAL PROPERTY RIGHTS.
Any and all intellectual property rights in the course materials are owned by us and will continue to be owned by us.
LEGAL AGE.
Participants must be 18 years or older on the day of the workshop. For individuals under 18, we are open to discussing their participation on a case-by-case basis. Please contact us to discuss further details.
COMPLAINTS.
Please report any perceived issues with the performance of this contract to the tour leader immediately to allow for a prompt resolution. If a satisfactory solution cannot be reached, please submit your written complaint to us within 28 days after the workshop's completion. Your feedback is important to us, and we are committed to addressing any concerns in a timely manner.
THE LAW.
Phuket Photography Tours accepts responsibility for acts and /or omissions of its employees (whilst acting in the course of their employment). Phuket Photography Tours does not accept responsibility or liability for death, bodily injury or illness caused to the client or any other person included on the booking form, unless arising from the negligent act and/or omission of the Phuket Photography Tours’ employees (whilst acting in the course of their employment). We do not make any warranty as to the course in general and in particular in relation to: (i) the presence or absence of any other attendees or the venue; or (ii) the benefit or outcome (commercial or otherwise) that you may achieve as a result of attending the tour or workshop. Any claims shall be subject to Thai law in respect of any question of liability or quantum, and all proceedings shall be within the exclusive domain of the Thai courts.
The client must communicate any perceived failure in the performance of this contract on the spot to the tour or workshop leader thus giving the workshop leader the opportunity to achieve a satisfactory solution. The decision of Phuket Photography Tours is final and no discussion will be entered into.
